Deem Weekly Draw Definitions
“Eligible Customer” means Deem Mastercard holders that spend a minimum of AED 100 per week or more will automatically be enrolled into the weekly draw.“Customer” means a Deem customer holding a valid and activated Deem Credit Card.
“Cardholder” includes a Deem primary Credit Card customer and a supplementary Credit Card customer.
“Deem Weekly Draw ” refers to the reward program applicable to Deem Titanium Mastercard, Deem Platinum Mastercard and Deem World Mastercard under which Customer gets an entry into the weekly draw of AED 100,000 every week with a spend of AED 100.
“MCC” means a merchant category code defined by Mastercard to classify transactions. The categorization of an MCC is determined by Mastercard at its sole discretion in accordance with its respective policies and Deem has no involvement in the same.
“Retail Transaction” means a purchase made using the Deem Credit Card by the Customer that excludes cash advances, quasi cash transactions, any refunds, any bank charge reversals, balance transfer transactions, Credit Card payments or any other transaction as determined by Deem from time to time.
“Spend Categories” means a group of MCCs, single or multiple. The list of Spend categories shall be determined by Deem at its sole discretion.
“Sum of Cycle” means the total sum of all purchases done and posted on the Credit Card during a particular Credit Card statement period.
Deem Weekly Draw Program
• Every AED 100 spend on Deem Mastercard within the 7 days of spend cycle (Monday to Sunday) will allow the customer a single entry into the weekly draw.
• All Deem Mastercard holders who have consented to sharing their personal information with Dream Dubai for the purpose of administering the prize.
• Eligible customers: Deem Mastercard holders that spend a minimum of AED 100 per week or more will automatically be enrolled into the weekly draw.
• All retail spends across all merchant categories other than quasi cash will be considered as part of the customer’s total eligible spends for the campaign.
• All spends on supplementary cards will be clubbed together with the primary card spends to determine eligible spends.
• The draw will be serviced by Dream Dubai under DET guidelines
• The weekly winner’s full name will be announced accordingly on Deem and Dream Dubai platforms.
• The winner will be notified via an email and SMS communication from Dream Dubai.
• Each winner will be serviced with the Prize by Dream Dubai within a maximum of 10 working days. The prize will be paid through an ‘A/C Payee’ cheque.
• The customer will not be included in the draw if he/she is not current on their account or any other Deem product.
• Customer will need to have valid KYC details on records in order to be eligible for the draw money.
• Employees of Deem and other entities under the Gargash Group are excluded from the Draw.
• Deem Credit Card Terms & Conditions apply.
• Deem General Terms & Conditions are available on Deem's website deem.io and are applicable in conjunction with these terms and conditions of the offer
• The prize draw and these terms and conditions will be governed by UAE laws and any dispute will be subject to the exclusive jurisdiction of the courts of Dubai
• The Customer acknowledges and confirms to have read, understood and unconditionally agrees to the above offer eligibility criteria and terms and conditions of the offer and accepted the same along with the General Terms and Conditions and any other terms and conditions as shall be specified by Deem from time to time
• Deem reserves the right to change the Terms & Conditions of the above draw and the customers will be duly notified of the same
Deem Weekly Draw Earning
• Participation in the weekly draw is automatic, provided that the Deem Mastercard is active and in good standing (including but not limited to the fact that the Customer has not failed to make his contractual monthly payments).
• All spends on supplementary cards will be clubbed together with the primary card spends to determine eligible spends.
• The program applies to all spends on the Deem Mastercard.
• Every AED 100 spend on the Deem Mastercard will qualify the customer an entry into the weekly draw, and any additional spend of AED 100 will get the customer another entry into the weekly draw of AED100,000.
Deem Weekly Draw Ticket Expiry
• The draw tickets are valid only for one week and will expire by the end of the 7 days of spend cycle (Monday to Sunday)
• In the event of card cancellation or if the card is blocked, written off, suspended for any reason whatsoever, the full week tickets will stand forfeited.
Easy Payment Plan
We shall offer Easy Payment Plan (hereinafter referred to as ‘EPP’) to Deem Credit card holders.
EPP is a repayment plan which allows you to repay in instalments over a tenor of 3 to 24 months. You can convert either your retail purchases over AED 250 or your credit card outstanding amount. The eligibility of the EPP is subject to approval from Deem at the time of application.EPP is available to all Deem customers who hold valid Credit Cards issued by Deem in the United Arab Emirates and make point of sale or online transactions above a minimum threshold amount identified by Deem from time to time.
Eligibility of card-holder to avail the EPP depends on his good standing of credit card at the time of request, repayment history and general performance of all Deem products. At the time of request, card shall not be blocked, outstanding balance is not over the limit and cardholder is regular on payments of all Deem products, for the eligibility.
Upon receipt of a Request by the Cardholder, Deem may approve or reject the EPP request. Once approved, EPP will be processed and details of the same will reflect in the subsequent month’s Credit Card statement.
By applying for an EPP, cardholder accepts the Monthly Instalment, the Tenure, the interest, fees and charges that will be levied by Deem as per the schedule of fee and charges.
The Request for EPP should be submitted at least 5 business days before the payment due date (as per the Credit Card statement).
Upon successful booking of the EPP, each outstanding monthly Instalment amount that is at that time due shall be specified in each account statement and will be due in each month forming part of the minimum amount payable.
In summary, Cardholders availing of the EPP will be charged as per below, on the total outstanding(s) on the Credit Card:
a. A non-refundable interest,
b. A processing fee for converting cardholder’s purchase transaction into EPP, and /or
c. Prepayment / Cancellation fee
d. In each case at the rate specified by Deem on its website
Interest will be payable in respect of each Instalment under the relevant EPP and shall be debited from the Card Account at the times determined by Deem and notified to the Cardholder.
The amount of the EPP transaction is included within the credit limit of the Credit Card and not in addition to the credit limit. As each payment is made towards the instalments each month, the available credit limit will be restored.
If the Cardholder is two instalments overdue under the EPP, Deem shall cancel the EPP and convert the EPP balance amount into a regular revolving interest bearing transaction. Upon cancellation of the EPP, the EPP balance amount would be billed at retail interest rate.
Successful Direct Debit Authorization (DDA) towards payment of Deem Credit card is a mandatory requirement to be met by the card holder, in order to avail EPP facility on Deem Credit Cards.
Deem may, in its sole and absolute discretion and without notice, withdraw or revise this Terms and conditions governing this Easy Payment Plan.
Cancellation / Early-closure of EPP:
a. EPP will be cancelled, on customer request, for the transactions which are refunded or voided.
b. Card-holder may request for the cancellation of an EPP. Deem shall cancel the plan in 30 days from the date of receipt of the card-holder’s cancellation request, and charge the balance amount due to the Credit Card account which forms part of the current outstanding balance on the Credit Card with effect from the date of cancellation.
c. Card-holder may choose to prepay the total balance on the “Easy payment plan” in one payment. Deem may charge a cancellation fee from time-to-time at its sole discretion towards the early closure of the plans.
d. A cancellation fee may be charged by Deem which may vary time-to-time at its sole discretion towards the cancellation of the ongoing EPP.
Easy Cash EPP
1. DEFINITIONS
In these Terms and Conditions where the context so admits the following expressions shall have the meanings herein designated unless the context otherwise requires:
1.1 “Easy Cash EPP” means the loan to be granted to the Credit Card holder by Deem according to these terms and conditions and includes Loan on Phone (LOP) products and the loans entered into via internet.
1.2 “Manager’s Cheque” means the cheque or any means of payment issued by Deem in favor of the Credit Card holder upon issue of Easy Cash EPP.
2. ELIGIBILITY
2.1 Easy Cash EPP is offered exclusively to Deem Primary Credit Card holders who meet the criteria determined.
2.2 The Credit Card holder shall only be eligible for Easy Cash EPP if he/she is within Deem’s criteria determined in accordance with Clause 2.1 above.
2.3 Deem shall grant Easy Cash EPP requested by the Credit Card holder at its sole discretion and reserves the right to reject an application for an Easy Cash EPP to any Credit Card holder without providing rationale for rejection. Deem may cancel, by notice to the Credit Card holder, its commitment to make Easy Cash EPP available or reduce the amount of Easy Cash EPP.
3. EASY CASH EPP Amount
3.1 The amount of any Easy Cash EPP shall be determined by Deem at its sole discretion and it shall not in any case exceed the Credit Card holder’s unutilized Credit Limit.
3.2 The Credit Card holder may request the amount of Easy Cash EPP from Deem, provided that the same is within the limit described in Clause 3.1 above.
3.3 Deem shall have the right to determine the amount of any Easy Cash EPP it grants at its sole discretion, provided that Easy Cash EPP is within the limit described in Clause 3.1 above and does not exceed the amount requested by the Credit Card holder.
4. BILLING
4.1 In consideration of Deem agreeing to make an Easy Cash EPP available to the Credit Card holder, the Credit Card holder agrees to repay the principal amount of the Easy Cash EPP plus all interest, charges and fees payable hereunder.
4.2 The Credit Card holder shall repay the Easy Cash EPP to Deem in monthly instalments during the term of the Easy Cash EPP booked.
4.3 The amount of each Easy Cash EPP monthly instalment shall be computed by dividing the total Easy Cash EPP amount by the number of months in the term selected by the Credit Card holder.
4.4 The total Easy Cash EPP amount shall be computed by adding the principal amount of Easy Cash EPP and the interest payable during the term of Easy Cash EPP.
4.5 Interest at the rate determined by Deem shall be charged on the Easy Cash EPP. Each Easy Cash EPP monthly instalment will include amounts for the repayment of principal and interest charges.
4.6 Easy Cash EPP monthly instalments shall be billed to the Credit Card holder in the Statement of Account. Billing shall commence from the first Statement of Account sent to the Credit Card holder following the disbursement of Easy Cash EPP.
5. REPAYMENT
5.1 The Credit Card holder shall be liable to pay the Easy Cash EPP in monthly instalments billed to the Statement of Account. If the Credit Card holder returns the full amount of Easy Cash EPP to Deem leaving Easy Cash EPP unused, any principal repayments charged to the Credit Card Account will be credited to the Card Account. Any interest payments and fees charged to the Credit Card Account will not be refunded to the Customer and will be considered as charges for the cancellation of Easy Cash EPP.
5.2 If the Credit Card holder pays less than the minimum payment due by the payment due date specified in the Statement of Account, charges and delay interest as per the attached terms and conditions and the Schedule of Fees and Charges will be applicable.
5.3 The Credit Card holder may repay the total Easy Cash EPP amount to Deem in one lump sum. A pre-closure fee at Deem’s prevailing rate shall be charged to the Credit Card holder in this case.
5.4 If the Credit Card holder fails to make payment in full of two consecutive Easy Cash EPP monthly instalments, the entire outstanding balance of the total Easy Cash EPP amount shall immediately become due and payable by the Credit Card holder, and Deem shall have the right to demand the immediate payment thereof.
5.5 Payments made in excess of the Credit Card outstanding will not automatically be adjusted against unbilled instalments and will hence not result in prepayment of Easy Cash EPP.
5.6 If an eligible Credit Card is cancelled prior to payment in full of all amounts outstanding under Easy Cash EPP facility, the entire amount outstanding on the eligible Credit Card (including billed and unbilled retail and cash transactions, all outstanding amounts under a Credit Card Instalment Facility, and all applicable fees and charges) shall be immediately due and payable by the eligible Credit Card holder, whereupon Deem shall have the right to demand immediate payment thereof.
6. MISCELLANEOUS
6.1 Easy Cash EPP amount will be transferred to the Credit Card holder’s UAE Bank Account by deducting the available balance on your credit card account.
6.2 The available balance on the Credit Card account will be reduced to the extent of the principal loan availed and will be released as and when the monthly instalments are billed and paid in the subsequent months.
6.3 Applications for a top up of a previously granted Easy Cash EPP that has been partially repaid by a customer will be considered in accordance with Deem`s policy at its sole discretion.
6.4 The Miles Up rewards points will not accrue on Easy Cash EPP transaction amount.
6.5 Deem reserves the right to terminate the Easy Cash EPP service without prior notice.
Balance Transfer
‘Balance Transfer’ facility is available to eligible Deem customers who hold valid Credit Cards issued by Deem Finance LLC in the United Arab Emirates.
Upon receipt of a Request by the Customer, Deem holds the authority to either approve or reject the requested balance transfer. If approved, customer will be informed with the details of the ‘Balance Transfer’.
Customer is responsible to continue to make timely payments to all the non-Deem Credit Cards while the application for Balance Transfer (BT) at Deem is still in process. Deem shall not be liable for any late payment fee, interest, fee, liabilities or obligations in respect of the customer’s non-Deem Credit Cards due to lack of timely payments from customer’s end, while the BT request is under process.
The approved BT amount may vary from what the customer has applied for.
Prevailing fee and charges for ‘Balance Transfer’ will apply.
The total amount of ‘Balance Transfer’ is included within the credit limit of the Credit Card and not in addition to the credit limit.
Customer shall also provide with the details of Credit Card accounts for the disbursement of ‘Balance Transfer’ amount. The disbursement is done via UAE FTS.
Successful Direct Debit Authorization (DDA) towards payment of Deem Credit Card is a mandatory requirement to be met by the Customer, in order to avail Balance Transfer facility on Deem Credit Cards.
Successful activation of the Deem Credit Card with-in 30 days of Credit Card issuance is a mandatory requirement to be met by the Customer, in order to avail Balance Transfer facility on Deem Credit Cards.
Deem may specify a minimum and maximum outstanding balance to be eligible for transfer to the Card Account.
Deem may, in its sole and absolute discretion and without notice, withdraw or revise the terms and conditions pertaining to ‘Balance Transfer’.
Supplementary Card
Supplementary card applicant must be 18+ years of Age. Supplementary card applicant must be directly related to the Primary cardholder (Spouse/ Parents/Children/Siblings)
Upon request by The “Principal Cardholder”, Deem at its sole discretion and determination may agree to issue a “Supplementary Card” and charge fees for such issuance. The “Principal Cardholder” shall be fully responsible and liable for payment of the value of The “Card Transactions” made by The “Supplementary Card”.
No separate credit limit will be assigned to the Supplementary card(s). The “Credit Limit” assigned to The “Principal Cardholder” shall be inclusive of The “Credit Limit” assigned to The “Supplementary Cardholder”.
All limits applicable on the primary card account will be for the combined usage of Primary and Supplementary card(s)
The validity of the “Supplementary Card” shall at all times be dependent on the validity of The “Principal Card”. If The “Principal Card” is terminated or cancelled, The “Supplementary Card” shall automatically be terminated and cancelled, but not vice versa.
All the product specific T&Cs will remain same for both Primary and Supplementary card(s)
All terms and conditions stated hereunder in this Agreement and Deem General Terms and Conditions are fully binding on and applicable to The “Supplementary Cardholder” who will be severally and jointly liable with the “Principal Cardholder.
Valtrans Valet Parking Services
Deem Platinum and World Credit Card holders are entitled to avail complimentary standard valet parking services each month by presenting their Deem credit card at the below locations.
Valtrans Valet Parking Services eligibility
- Deem Platinum Credit Card holders: can avail 4 complimentary standard valet parking services per month.
- Deem World Credit Card holders: can avail 6 complimentary standard valet parking services per month.
Note:
Utilization of standard valet parking service for Platinum and World cardholder is subject to a minimum monthly cumulative Spend of AED 3,000 and AED 6,000 respectively, in the previous billing cycle.
Any Additional valet parking usage (more than 4 and 6 parking services per month, for Platinum and World cardholders respectively) will be a paid service based on Valtrans Standard Valet parking service fee table below.
This will also apply in the event that the customer does not meet the minimum spend criteria.
The above rates are only for standard valet parking services.
This offer is valid only on Standard valet parking services and is not applicable on VIP services. If VIP services are availed by the customer, usage of one VIP service will be equivalent to 2 standard valet parking services.
The complementary valet parking services at Dubai Airports is available only for Deem World card holders. The same is valid only for the first hour of valet services at Dubai International Airports T1,T2 and T3. Please note any subsequent hour(s) of parking is chargeable to cardholder.
In the event that the customer does not meet the minimum spend criteria or exceeds the stipulated complimentary visits, any such charges will be billed on the Deem Credit Card based on the table above.
Insurance
Deem Finance LLC (“Deem”) neither underwrites insurance policies nor is responsible for rejected applications or claims by the Insurance Provider and acts only as a distributor to the Products (Deem Double Secure and Deem Credit Life Plus issued by preferred Insurance Providers) without warranties of any kind either expressed or implied by Deem. Terms and Conditions of the Insurance Provider shall apply on the Products. Deem shall not be liable for any loss or damage arising directly or indirectly to Deem customers in relation to the Products. Deem has the right to change the Insurance Provider at its sole discretion.

Privacy policy
In this document, capitalised terms used but not defined herein shall have the meaning given to them in Deem’s General Terms and Conditions, a copy of which is available for viewing at https://www.deem.io (the “Website”).
1. INTRODUCTION
1.1 Keeping the user’s personal information secure and ensuring the user’s understanding of how we at Deem use the information is important to us. Deem’s goal is to help the user understand how the personal information the user chooses to share with Deem through the Website is collected, used, maintained and disclosed where required. This privacy policy (the “Privacy Policy”) sets forth the terms on which Deem will collect, process, use and disclose information of the user. The user may review this Privacy Policy at any time by clicking on the ‘Privacy’ link appearing at the bottom of one or more pages of the Website.
2. REGISTERED USERS
2.1 By using or accessing this Website, the user agrees to the collection, disclosure and use of data by Deem in the manner provided in this Privacy Policy. Deem’s Privacy Policy does not extend to websites owned or managed by third parties or for data or information disclosed by the user to third parties.
2.2 Deem may track the internet protocol address/mobile device from which users visit the Website and analyse this data for trends and statistics independently or as per an agreement with Deem’s affiliates. Deem uses the information it automatically receives from the user’s web browser/mobile device to see internally which pages the user visits within the Website, which Website the user visited before coming to Deem’s Website, and where the user goes after he leaves. Deem develops statistics that are helpful to understand how Deem’s visitors can use this Website. Deem uses this information in the aggregate to measure the use of the Website and to administer and improve the Website. This statistical data is interpreted by Deem in its continuing effort to present the Website content that visitors are seeking in a format the users find most helpful.
2.3 Users are required to provide certain other information as provided in this Privacy Policy or as provided/required under other terms of use of the Website. This Privacy Policy also provides, inter alia, the use of information collected by Deem, the recipients to whom such information is intended to be disclosed to, type of information collected; and reasonable security practices and procedures adopted by Deem.
3. CATEGORIES OF INFORMATION COLLECTED
3.1 Upon enrollment/registration on the Website, the user chooses to provide Deem with certain personal information such as the user’s name, address, e-mail address and telephone number and agreement to the terms governing the use of the Website. The user can update their registration information online. The user may change their password at any time.
3.2 Deem collects the following general types of information about the user when they visit the Website: personal information, demographic information, behavioral information and indirect information.
3.3 Personal information is information that can be used to identify the user, or any other individual to whom the information may relate, personally. Deem does not collect personal information unless the user chooses to provide it to Deem. Some examples of personal information that Deem collects are: name, address, email address, number, payment details, contact information, billing information, shipping information, information about third parties, such as references, mentors or contacts.
3.4 Demographic information is information that is not unique to the user in the sense that it refers to selected population characteristics, such as a postal code, age, preferences, gender, occupation, career history and interests.
3.5 Behavioural information is information on how the user uses the Website and mobile applications, the areas of the Website that the user visits, what services the user accesses, and information about the user’s computer hardware and software including your IP address, device information (such as your hardware model, operating system version, unique device identifiers, and mobile network information including phone number), geolocation, log information (device event information such as crashes, system activity, hardware settings, browser type, browser language, the date and time of your request and referral URL), browser and operating system type, domain names, access times and referring website addresses. This information is necessary for analysing the use of resources, troubleshooting problems, preventing fraud, and improving our services or providing additional services.
3.6 Indirect information is information Deem may collect about the user when the user uses certain third party services on the Website.
3.7 If the user chooses not to provide the information Deem requests, the user can still visit this Website, but the user may be unable to access certain options, offers and services.
4. USES AND PURPOSES OF COLLECTING INFORMATION
4.1 Deem may personalise the services on the Website. In order to provide this personalisation, in addition to information Deem collects about the user on the Website, Deem acquires information (including personal, demographic, behavioural and indirect information) about the user from third parties. Deem will also strive to use any and all information provided by the user to enhance the utility of the Website for the user.
4.2 Deem may share the user’s information with third parties in relation to the services provided on the Website. Deem discloses information to companies and individuals it employs to perform functions on its behalf. Examples include hosting our web servers, analysing data, providing marketing assistance, processing card payments and providing customer service. Deem may use the information its collects from the services to provide, maintain, protect and improve the services, to develop new ones, and to protect Deem and its other users. Deem also uses this information to offer the user tailored content – like giving the user more relevant search results and advertisements. Deem may use the email address and other details to inform the user about Deem’s services, such as letting the user know about upcoming changes or improvements. The personal information provided by the user and the personalised data created and saved by the user on the Website is used to provide superior service to the user and to inform the user of various products, services, or other opportunities that may be available or become available through Deem or its affiliates. This may include disclosure of such information to employees, representatives, officers, agents, affiliates, government and regulatory entities, third parties, agents, contractors, sub-contractors and service providers. Such information and data will also be used to administer Deem’s business, the Website, the services and to process the user’s requests in a manner consistent with this Privacy Policy, the terms and conditions that govern the use of this Website and all Applicable Laws, rules, regulations, or other legal obligations. If the user provides Deem with his name, address, telephone number or e-mail address, or has done so in the past, Deem or its affiliates may contact the user by telephone, mail or e-mail. E-mail or other electronic communications sent to Deem through the site will be maintained in a manner consistent with the legal and regulatory requirements regarding client and public communications. To enable Deem to serve the user better, it is necessary that the user’s personal information available with Deem is updated at regular intervals and is accurate.
4.3 Online advertisements may be posted by other companies on third party sites that carry our advertising. These companies may set cookies and use related technology, such as encoded URLs or other tracking mechanisms that may note how internet users respond to an online advertisement. For example, users that click on an online advertisement may be redirected to our Website with an encoded URL or other tracking technology that may collect and store information about Website visits, time spent, or a specific advertisement. Generally reported as aggregate and anonymous data, such information can help Deem understand for example the performance of online advertising. Third party sites that show our online advertising are often independent businesses that provide their own privacy statements. We are not responsible for such statements or websites. You should always review the privacy representations of those third party sites that you visit before you use them and particularly before you share personal information.
4.4 Deem may share or disclose to its affiliates and or third parties any information derived from the registration on, or use of, any online service (including names and addresses): (a) in order to better service the needs of the users; (b) to make offerings /services more relevant to the users; (c) to keep track of point transactions; (d) to resolve any disputes; (e) to deal with requests, enquiries or complaints and other customer care related activities; (f) for all other general administrative and business purposes; (g) for carrying out any activity in connection with a legal, governmental or regulatory requirement or in connection with legal proceedings, crime or fraud prevention, detection or prosecution; (h) to effectively administer and fulfil our obligations under any agreement Deem may have with the user; (i) for preparing quarterly statements and account maintenance; (j) to organise, process, clean and analyse Deem’s data to help Deem better understand the trends and segments in the industry; (j) to provide the user additional communications, information, and promotions such as newsletters; (k) to contact the user about the Website and any updates, informational and service-related communications, including important security updates (l) for domain and system administrators. Any personal data and information that Deem may receive from any user or its peers, including by virtue of any peer reviews, recommendations or endorsements, can be used by Deem, its affiliates, its group companies, its associates for use and reuse, however, reasonable care will be taken by Deem to not misuse such data. Notwithstanding the foregoing, Deem shall not be responsible for any acts or omissions of its associate companies or advisors who misuse such data and information of the user.
4.5 Deem may combine personal information from its one service with information from another service, including personal information, from other services for example to make it easier to share things with people the user may know.
4.6 Deem may disclose and transfer such information to a third party who acquires any or all of Deem’s business units, whether such acquisition is by way of merger, consolidation or purchase of all or a substantial portion of our assets. In addition, in the event that Deem becomes the subject of an insolvency proceeding, whether voluntary or involuntary, Deem or its liquidator, administrator, receiver or administrative receiver may sell, license or otherwise dispose of such information in a transaction approved by the court.
5. METHODS OF COLLECTING INFORMATION
5.1 The Website stores and uses “cookies” so that Deem can better serve the user with customized information when the user returns to the Website. Cookies are identifiers which a web site can send to a browser to keep on the user’s computer to facilitate the users next visit to the Website. The user can set his browser to notify him when he sends a cookie, giving the user the option to decide whether or not to accept it. The information Deem collects and analyses is used to improve the Service. The user agrees that Deem or its third party service providers collect the user’s IP address or other unique identifier. At times, Deem also uses these identifiers to collect information regarding the frequency with which the users visit various parts of the Website. Deem, either through itself or through affiliates or group companies may combine the user’s IP address with other personally identifiable information for providing specialised services (including marketing and for market research purposes), including internal demographic studies, so Deem can optimise the products and services and customise the Website for the user.
5.2 Deem may combine the user visitor session information or other information collected through cookies, web beacons and other technical methods with personally identifiable information in order to understand and improve the user’s online experiences and to determine what products, promotions and services the user prefers or are likely to be of interest to the user. Among other things, Deem collects and obtains information provided by the user: (i) at the point of registering as a user; (ii) by posting material to the Website; (iii) by storing a copy of the user’s resume and any other information the user provides when he sends it to a recruiter; or (iv) by completing online requests for application packs.
5.3 Deem also uses these technical methods in HTML e-mails that Deem sends the user for a number of purposes including: to determine whether the users have opened or forwarded those e-mails and/or clicked on links in those e-mails; to customise the display of the banner advertisements and other messages after the user has closed an email; and to determine whether the user has made an enquiry or available services in response to a particular email. Deem may collect and store information (including personal information) locally on the user’s device using mechanisms such as browser web storage (including HTML 5) and application data caches.
5.4 Cookies, web beacons and other technical methods may involve the transmission of information either directly to Deem or to another party authorised by Deem to collect information on Deem’s behalf. The information from use of these technical methods may be collected in a form that identifies the user personally. The user may get cookies from Deem’s advertisers. Deem does not control these cookies, and once the user has clicked on the advertisement and left the Website, Deem’s Privacy Policy no longer applies.
5.5 If the user posts any of his personal information in public areas of the Website, such as on online forums or chat rooms, such information may be collected and used by others over whom Deem has no control. Deem cannot control the use made by third parties of information the user posts or otherwise makes available in public areas of the Website.
6. REASONABLE SECURITY PRACTICES AND PROCEDURES
6.1 Deem will take reasonable steps to protect the information the user shares with Deem. Deem has implemented technology and security features and strict policy guidelines to safeguard the privacy of the user’s personally identifiable information from unauthorised access and improper use or disclosure. The information sought will be used only for the furtherance of Deem’s business and to enhance the user’s experience and not for any illegal or unlawful purposes.
6.2 Deem shall take reasonable steps to ensure that the confidentiality of the information belonging to the user is maintained by imposing strict confidentiality standards on all the third parties, agents, contractors, sub-contractors and service providers with whom it may share such information.
7. GENERAL
7.1 If Deem’s Privacy Policy changes in the future, it will be posted here and a new effective date will be shown. The user should access Deem’s Privacy Policy regularly to ensure that the user understands the extant policies. The user shall make reference to the Privacy Policy in the subject line of any communication to Deem. Deem will attempt to respond to all reasonable concerns or inquiries on a best efforts basis within a reasonable period of time.
7.2 Because of the nature of the internet, Deem may transmit the information collected from the user to another country for purposes such as for storage, or for carrying out the processing detailed above, or because of where Deem’s servers are located.
7.3 Deem may change this Privacy Policy from time to time without requiring any consent from anyone and Deem will post the latest version on this Website.
7.4 Information posted in public areas of the Website or place in the searchable resume database can be accessed, used, and stored by others around the world, including those in countries that might not have legislation that guarantees adequate protection of personal information as defined by the country of residence of the user.
8. AGREEMENT TO PRIVACY POLICY
8.1 By accessing the Website, providing personal information for inclusion in Deem’s database or placing orders through the Website, the user hereby unconditionally and irrevocably consents to his information being stored, used, altered, modified, dis-assembled, shared and disseminated as described in this Privacy Policy.

Deem WhatsApp
These terms and conditions (“WhatsApp Terms and Conditions” as amended from time to time) are applicable to the Customers (defined hereinafter) who avail the Services (defined hereinafter) provided thereon by Deem on WhatsApp platform for existing and potential customers for services.
The WhatsApp Terms and Conditions shall be in addition to any other terms and conditions as stipulated by Deem from time to time on its website (deem.io) pertaining to Deem products services.
Any services that may be offered to the customer through the WhatsApp platform (“WhatsApp”) is at the discretion of Deem and/or basis the eligibility criteria of a customer and such services are subject to certain terms and conditions.
Further, in case of inconsistency between the WhatsApp Terms and Conditions and any specific terms and conditions pertaining to a specific variant of the account or any specific service/product/offer, the specific terms and conditions of that particular service/product/offer shall prevail.
1. INTERPRETATION
(i) The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.
2. DEFINITIONS
“Customer” shall mean any person holding a product with Deem and interacting with the company on WhatsApp using Deem’s Registered Number / using the Services provided by Deem through WhatsApp.
“Customer Information” refers to the personal data or information or such other data or information including any sensitive personal data in relation to the Customer such as information in relation to the credit card balance of the Customer, shared by the Customer or provided to the Customer by Deem or collected or obtained from the Customer or from WhatsApp or from any such source in the course of the Customer availing the Services hereunder.
“Registered Customer Number” is the mobile number which the Customer has registered with Deem.
"Device" means a computer, laptop, mobile phone, tablet or any other similar device that enables the Customer to access WhatsApp and use the Services.
“One Way Communication” shall mean the service provided by Deem to the Customer on WhatsApp where the Deem sends its Customer one-way messages through its Registered Number in the nature of information, alerts, updates, transaction alerts in relation to the Customer’s Account and such other communications as Deem may enable from time to time, at its discretion.
“Service(s)” shall mean the One Way Communication and Two Way Communication services provided by Deem by itself or through any of its service providers, to a Customer on WhatsApp.
“Two Way Communication” shall mean the service provided by Deem to the Customers on WhatsApp where the Customer can communicate with Deem by sending it messages in the form of making requests, seeking information, asking queries etc. on Deem’s Registered Number and where Deem responds to such messages. However, this service and Deem’s responses shall be limited only to such queries, information, requests etc. as may be determined by Deem from time to time, at its sole discretion.
“WhatsApp” is the application provided by WhatsApp Inc. 1601 Willow Road, Menlo Park, California 94025.
3. ACKNOWLEDGMENT
These are the Terms and Conditions governing the use of this Service and the agreement that operates between the Customer and Deem. These Terms and Conditions set out the rights and obligations of all users regarding the use of the Service.
The Customer’s access to and use of the Service is conditioned on his/her acceptance of and compliance with these Terms and Conditions.
By accessing or using the Service the Customer agree to be bound by these Terms and Conditions. If the Customer disagree with any part of these Terms and Conditions, then he/she may not access the Service.
The Customer’s access to and use of the Service is also conditioned on his/her acceptance of and compliance with the Privacy Policy of Deem. Our Privacy Policy describes our policies and procedures on the collection, use and disclosure of the Customer’s personal information when he/she use the Application or the website and tells him/her about his/her privacy rights and how the law protects the customer.
4. USER ACCOUNTS
Deem will use WhatsApp Messenger (“WhatsApp/ Service/ Facility”) as an additional channel to communicate with customers from time to time for services listed above and will be free to expand scope of communications from time to time.
When the Customer create an account with Deem. The Customer must provide Deem information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of the Customer’s account on Deem’s Service.
The Customer is responsible for safeguarding the OTP code recived at his/her registered number with Deem that he/she uses to access the Service and for any activities or actions under his/her OPT.
The Customer agree not to disclose his/her OTP code to any third party. The Customer must notify Deem immediately upon becoming aware of any breach of security or unauthorized use of his/her account.
4. CONTENT
The Customer’s Eligibility for using Deem’s WhatsApp Services.
Deem’s WhatsApp Service is granting the Customer an additional channel for communicate from time to time.
The Customer hereby agrees and undertakes that he/she shall use the Services only if he/she fulfils the eligibility as given below:
a) The Customer are eligible to use the WhatsApp services locally and internationally against the registered mobile number with Deem.
b) The WhatsApp Services are only available for UAE residents.
c) The Customer has registered its Mobile Number and Emirates ID with Deem.
d) Non-Customers will be provided limited services such as apply for any of Deem products.
5. APPLICABILITY OF WHATSAPP TERMS AND CONDITIONS
These WhatsApp Terms and Conditions form a contract between the Customer and Deem. The Customer shall apply to Deem in the prescribed manner for availing of the Services.
By applying and opting in for the Services, the Customer acknowledges that he/she has read, understood and accepted these WhatsApp Terms and Conditions and other specific terms and conditions as may be pertaining to Deem products/offers/facilities and services availed by the Customer whether or not through WhatsApp.
No act, delay or omission by Deem shall affect its rights, powers and remedies under these Terms and Conditions and other terms on Deem website (deem.io), hereinafter referred to as “Website”.
The Customer hereby accepts and agrees that all Services and communications (both One Way Communication and Two Way Communication) taking place on WhatsApp, initiated either by Deem or the Customer, will be governed by and subject to these WhatsApp Terms and Conditions. Further, the Customer hereby agrees that the Customer grants express authority to Deem for carrying out the Services requested by the Customer on WhatsApp on Deem’s Registered Number. Provided however that Deem shall be required to authenticate the Customer through the registered mobile number and OTP process, Deem shall be entitled to presume that it is the Customer itself which is interacting through WhatsApp and in case of non-Customer Deem shall be entitled to presume that the number reflected in the WhatsApp profile is the said non Customer’s number and it is the said non Customer itself and not any other person who is interacting with Deem’s Registered Number. Deem’s own record or log of transactions maintained through computer systems or otherwise shall be accepted as conclusive and binding for all purposes.
6. SERVICES
The Customer agrees and accepts that Deem reserves the right to provide only such Services as the Deem may at its discretion permit from time to time. Deem may also inform/update the availability/non-availability of any particular Service, at its sole discretion. The Customer hereby agrees that Deem may at any time, without notice to the Customer, modify, discontinue or make additions/deletions to the Services offered to the Customer. The Customer agrees that he shall not hold Deem responsible for not responding to the queries of/ information sought by the Customer or not providing a response to the satisfaction of the Customer or not processing any request of the Customer, in case such a message sent by the Customer and Deem does not receive an instruction to this effect in its systems or the message sent by the Customer is not in the format as required by Deem or does not fall under the Services being offered by Deem at the time or Deem does not receive such a message for technical reasons or otherwise or for any reason whatsoever.
Deem will have no liability in case of any fraud or impersonation incidents through the WhatsApp platform. Further, in case Deem permits any Service in the nature of a transaction, the Customer agrees that such a Service shall be subject to statutory/ regulatory limits and/or any limits that may be imposed by Deem, from time to time, at its sole discretion.
2. REGISTRATION AND VERIFICATION
For availing the One Way Communication and Two Way Communication service, the Customer agrees and confirms to have accepted
a) WhatsApp Terms and Conditions applicable to the Customer for availing the Services mentioned herein;
b) any other product/service/offer related specific terms and conditions as applicable and
c) all Terms and Conditions prescribed by WhatsApp for using its platform.
d) Provided that, Deem may modify the process for authentication, registration and/or verification of the Customer, for One Way Communication and/or Two-Way Communication, at any time, at its sole discretion.
Customer may continue to receive SMS and email alerts for selected communications. Subscribing to the Service will be taken as explicit consent of a Customer to receive communication from Deem on WhatsApp
Subscription obtained will be deemed applicable for all linked accounts/ cards which have the same mobile number registered with Deem
Upon subscribing to the Facility, a customer agrees that Deem shall share customer’s registered mobile number and name as available in Deem’s official records with WhatsApp
3. IMPORTANT NOTE:
The Customer shall apply to Deem for use of the Services (and/or for any changes to the options available under the Services) in such manner and through such modes as may be specified and made available by Deem from time to time including but not limited to application through forms as prescribed by Deem, Deem Customer Care number when made available as permitted modes by Deem for use of the Services through the WhatsApp platform.
Deem in its sole discretion shall decide the devices, software platforms, versions, networks, methods, and data services that will be supported by the WhatsApp platform for providing these Services. Any attempts to modify unsupported versions for use in the WhatsApp platform will be treated as unauthorized use and violation (“Unauthorized Use”) of these WhatsApp Terms and Conditions. The Services through the WhatsApp platform shall be suspended with immediate effect if there is Unauthorized Use by the Customer.
The Customer agrees that he/she shall be responsible for upgrading any software, hardware and the operating system at his/her own cost from time to time so as to be compatible to continue to avail the Services offered by Deem. Deem shall be at liberty to change, vary or upgrade its software, hardware, operating systems, etc. from time to time and shall be under no obligation to support the software, hardware, operating systems used by the Customer and that the same shall be the Customer’s sole responsibility.
Some Services may not work on an outdated platform and hence it is Customer’s sole responsibility to ensure timely upgradation of the WhatsApp platform.
By subscribing to Services on WhatsApp platform, the Customer agrees to get notifications via WhatsApp including account information, transaction details, and other services/communications. Customer also agrees to receive notifications including offers, new product features, any other important notification sent by Deem from time to time etc. on the Registered Customer Number via WhatsApp.
The Customer irrevocably and unconditionally authorizes Deem to access all his/her Credit Card/ loan account or other transactions for the Service requests received through the WhatsApp platform and to share the account information with any third parties for the purpose of accepting/ executing such Service requests of the Customers.
The Customer agrees that any Account related Services including in relation to any card, loan related information/Service etc. (at the discretion of the Deem) shall be provided to the Customers through WhatsApp platform only to a WhatsApp account associated with the Registered Customer Number.
The Customer is aware that it may not be possible for Deem to give detailed information on the Service/functionalities. Deem shall not be responsible or liable to customer or any third party for the consequences arising out of or in connection with using of this Service or with respect to the limited information provided by Deem on WhatsApp. In case the Customer requires further information, Customer can reach out to Deem either by visiting Deem’s official website on www.deem.io or contacting Deem Customer Care number.
The responses sent by Deem on WhatsApp platform (either for One Way Communication and/or Two Way Communication) are based on a program running at back-end. This program has been developed and regularly enhanced to handle the queries in best possible manner. However, for any answers that the Customer may not find satisfactory or for any inaccuracies arising therefrom, Deem shall not be held responsible. The Customer may call Deem Customer Care number or visit Deem’s official website on www.deem.io in case of any clarifications.
The Customer agrees that Deem and / or its affiliates may hold and process the Customers personal information concerning the account/s on computer or otherwise in connection with the WhatsApp facility as well as for analysis, credit scoring and marketing. The Customer using the WhatsApp facility authorizes Deem to collect and use technical information and any data and information, whether internet-based or wireless, to improve Deem’s products and to provide services to the Customer.
All records of Deem generated by the transactions arising out of use of the Services through the WhatsApp platform, including the time of the transaction recorded shall be conclusive proof of the genuineness and accuracy of the transactions.
Where Deem considers the instructions to be inconsistent or contradictory with any past instructions or any simultaneous instructions provided by Customer to Deem through other channels provided by Deem it may seek clarification from the Customer before acting on any instruction of the Customer or act upon any such instruction as it may deem fit. Deem shall have the right to suspend the Services if Deem has reason to believe that the Customer's instructions may lead to direct or indirect loss or may require an indemnity from the customer.
The Customer accepts that all information /instructions will be transmitted to and /or stored at various locations and be accessed by personnel of Deem (and its affiliates) or its service providers.
The Customer is responsible for keeping security safeguard of his WhatsApp account linked to the mobile number.
The Customer understands that using WhatsApp application may carry extra risks and may not be secured. Further any message and information exchanged is subject to the risk of being read, interrupted, intercepted, or defrauded by third party or otherwise subject to manipulation by third party or may involve delay in transmission. Deem shall not be responsible or liable to the customer or any third party for the consequences arising out of or in connection with using of this Service.
The Customer understands that mobile phones are vulnerable to the threats such as but not limited to -
a. Access by intruders to the data /information;
b. Identity theft;
c. Privacy violations;
d. Planting of stealth software and viruses;
e. Disablement or distortion of operations; and
f. Interception of the transmission of encrypted data/message etc.
The Customer shall immediately notify Deem in writing if Customer discovers/ suspects unauthorized access.
Deem shall not be responsible or liable to the Customer or any third party for the consequences arising out of or in connection with using of this Service. The Customer should immediately opt-out of the Services as per the unsubscribe process as detailed in section 8 above.
The Customer is aware that using mobile applications involves many uncertain factors and complex software, hardware, systems, etc. which are susceptible to interruptions and dislocations. Deem does not make any representation or warranty that the WhatsApp facility/service will be available at all times without any interruption and further that Deem shall not be responsible for any variation, reduction or imposition of the terms or the customer’s inability to use the mobile application. The Customer is aware that authenticated technologies and strict security measures are required for using mobile applications.
The Customer undertakes to ensure that the Password/Credit Card Number / OTP / CVV / is not revealed to any third party including Deem officials or any unauthorized person. Customer shall be solely responsible for all the communication exchanged between customer and Deem while logging into this service.
Under no circumstances shall Deem, or any of its officials, employees, be liable for any direct, indirect, punitive, incidental, special, or consequential damages that result from the use of, or inability to use, this service or for receipt of any answer provided by Deem program running at the back-end.
The Customer agrees that the Customer shall not have any claim against Deem on account of any suspension, interruption, non-availability or malfunctioning of the WhatsApp service due to any link/mobile/system failure at Deem’s end or for any reason thereof.
The Customer shall not reproduce, copy, or redistribute for commercial purposes any materials or design elements of this WhatsApp service.
4. CONTENT RESTRICTIONS:
The Customer shall ensure appropriate data network connection. Receipt of messages by Customer shall be subject to the data network connection and Deem shall not be held responsible for any delay or non-receipt of the responses at WhatsApp channel.
The Customer shall not submit or transmit any content through this WhatsApp channel that is unlawful, offensive, upsetting, intended to disgust, threatening, libelous, defamatory, obscene, or otherwise objectionable. Examples of such objectionable Content include, but are not limited to, the following:
a. Unlawful, or promoting unlawful activity;
b. Defamatory, discriminatory, or mean-spirited content, including references or commentary about religion, race, sexual orientation, gender, national/ethnic origin, or other targeted groups;
c. Spam, machine – or randomly – generated, constituting unauthorized or solicited advertising, chain letters, any other form of unauthorized solicitation, or any form of lottery or gambling;
d. Containing or installing any viruses, worms, malware, Trojan horses, or other content that is designed or intended to disrupt, damage, or limit the functioning of any software, hardware or telecommunications equipment or to damage or obtain unauthorized access to any data or other information of a third person;
e. False information and features;
f. Violating the any law of the United Arab Emirates and/or the jurisdiction in which customer resides.
g. Infringes the privacy and/or intellectual or copyrights of Deem or a third party.
h. Impersonates any person or entity including Deem and its employees or representatives.
Deem reserves the right, but not the obligation, to, in its sole discretion, determine whether or not any Content is appropriate and complies with this Terms, refuse or remove this Content. Deem further reserves the right to make formatting and edits and change the manner or any Content. Deem can also limit or revoke the use of the Services if the Customer post such objectionable content. As Deem cannot control all content posted by users and/or third parties on the service, the customer agree to use the Service at his/her own risk. The Customer understand that by using the Service he/she may be exposed to content he/she may find offensive, indecent, incorrect, or objectionable, and agree that under no circumstance will Deem be liable in any way for any Content, including any errors or omissions in any content, or any los or damage of any kind incurred as a result of his/her use of any content.
All instructions for availing the services under the WhatsApp facility shall be provided through the Registered Customer Number in the manner indicated by Deem. The Customer is also responsible for the accuracy and authenticity of the instructions provided to Deem and the same shall be considered to be sufficient for availing of the services under the WhatsApp facility. The alerts would be sent on the mobile phone number, last registered with deem.
The Customer agrees that if he/she notices any error in any information supplied to the Customer by the use of any of the Services, the Customer shall inform Deem of the same, as soon as possible. Deem will endeavor to correct the error promptly. The Customer agrees that all outputs of statements that may appear on WhatsApp, upon making a request to that effect, are information extracted from a computerized back up system maintained by Deem and may not be continuously be updated in real time. Deem shall provide the information as may be last updated on the systems of Deem. While Deem will take all reasonable steps to ensure the accuracy of the statement, Deem is not liable for any error and shall not hold Deem responsible for any loss incurred or action taken by the Customer by relying on such information.
The Customer agrees that the responses received by the Customer from Deem are based on program running at backend. This program has been developed and regularly enhanced to handle the queries in best possible manner. However, for any inappropriate/inaccurate answers or any answers that the Customers may not find satisfactory, Deem shall not be held responsible.
It is recommended for Customers who have subscribed to this WhatsApp service to delete WhatsApp application when changing their device so as to ensure there is no misuse of the same.
Deem has the right to retract the Customer’s right to utilize the Service anytime it deems fit without any notice to the Customer.
The Customer hereby acknowledges that he is availing the Service(s) at his own risk and the Customer shall not hold Deem responsible or liable for any of the risks including but not limited to the following:
a. Mistake/Error- the Customer acknowledges that the Customer may be sent responses or shown information which may not be applicable to him/her or may not be sent a satisfactory response, and the Customer agrees that in such a scenario the Bank shall not be liable for any loss to the Customer in this regard. The Customer shall therefore take all care to ensure that there are no mistakes and errors and that the message sent/ request made/ query asked by the Customer to Deem in this regard is error free, accurate, proper and complete at all points of time. The Customer agrees that Deem is providing the Services at the Customer’s sole risk. The Customer agrees that Deem shall not be liable for any loss, damages or consequences whatsoever arising due to any erroneous or incomplete information or any delay in executing the instructions for reasons beyond the control of Deem. The Customer shall be liable and responsible to Deem and accede to accept the Deem’s instructions without questions for any unfair or unjust gain obtained by him in the course of availing of the Services.
Customers are requested to ensure necessary due diligence in installing the WhatsApp (using his/her contact number) on other devices which can be accessed by others and registering the same number to avail this Facility. Deem shall not be responsible in any way in the event a Customer suffers any loss, injuries or harm as a consequence of gaining access to confidential information of the Customer available in the Facility by a third party.
In case of change of mobile number registered with Deem, customer will need to call Deem Customer Care to make necessary changes to the existing customer information with Deem.
Deem will continue to send messages/alerts on Customer’s device even if the SIM belonging to the registered mobile number has been removed as the phone number will still be registered for the Facility. It is the customer’s responsibility to install WhatsApp on the mobile phone/ device on which the registered mobile number is being used, in order to correctly receive WhatsApp messages being sent from Deem.
Customer shall ensure appropriate network connection on the device/ mobile phone on which the Facility is being obtained. Receipt of messages by Customer shall be subject to the network connection and Deem should not be held responsible for any delay or non-receipt of the responses from Deem due to non-compatibility of device, internet usage plans, insufficient network connection from service provider or any other reason whatsoever.
Customers are not bound in any way to obtain this Facility as acceptance of the Facility is voluntary in nature. By obtaining this Facility, the Customers agree to be bound by the terms & conditions contained herein. Without a Customer being required to do any further act, he/she shall be deemed to have read, understood and unconditionally accepted the terms & conditions herein. The above Terms & Conditions need to be read in conjunction with Deem’s Terms and Conditions.
5. THIRD PARTY
WhatsApp Services is owned by a third-party unaffiliated with Deem. The Customer shall independently be guided by the privacy policies of WhatsApp and the third parties or group companies of WhatsApp and Deem has no control over them. Deem is not responsible for the privacy or security policies at these sites or other third-party sites that may be linked to within the Deem’s social media channels.
The Customer should always review the privacy and security practices and policies of each third-party site they visit. Deem does not endorse and is not responsible for any ads, content, products, advice, opinions, recommendations or other material of third-party sites that may be promoted via advertising within any social media channels.
The Customer further understands and agrees that WhatsApp or any other service provider through which Deem is providing the WhatsApp facility can review and monitor, store the contents shared/communicated through the WhatsApp or other service provider(s) and may share the same with third parties.
6. DISCLAIMER OF LIABILITY
Deem shall not be responsible for any failure on the part of the Customer to utilize the WhatsApp facility due to the Customer not being within the geographical range within which the WhatsApp facility is offered and which forms part of the roaming network of such cellular service provider, providing services to the Customer availing such roaming facility from the respective cellular service provider. If the customer has reason to believe that the mobile phone number is / has been allotted to another person and / or there has been an unauthorized transaction in the account and / or his mobile phone handset is lost, he shall immediately inform Deem of the same.
The Customer agrees that Deem shall not be liable if:
the Customer has breached any of the terms and conditions, contained herein or
the Customer has contributed to or the loss in result of failure on part of the Customer to advise Deem within a reasonable time about unauthorized access of or erroneous transactions by use of the Services; or as a result of failure on part of the Customer to advise Deem of a change in or termination of the Customer's mobile phone numbers/SIM (“Subscriber Identity Module”) cards. Any unauthorized use of the customer's OTP/debit card PIN, password or mobile phone number or for any fraudulent, duplicate or erroneous instructions given on the WhatsApp channel;
there has been an unauthorized transaction/instruction provided through the WhatsApp channel as a result of any person having control or custody of telecommunications instrument (such as the mobile handset) so that such instrument may be used to give telecommunications instruction without authorization or any other issue/default/error/technological problem in the telecommunication instrument (such as the mobile handset) or duplication of mobile number / SIM of the Customer such as but not limited to SIM card cloning, virus in handset etc.
acting in good faith on any instructions received by Deem from or on behalf of the Customer in relation to the WhatsApp facility
error, default, delay or inability of Deem to act on all or any of the instructions given by the
a. Customer due to any reason;
vi. unauthorized access by any other person to any information /instructions given by the Customer
a. or breach of confidentiality
Deem makes no representation or gives no warranty with respect to the quality of the service provided by any cellular service provider or by WhatsApp or any other service provider enabling Deem to deliver services through WhatsApp to the Customers.
Deem may provide any other services as a part of the WhatsApp facility and Deem shall not be liable for the oversight on part of the Customer to update himself /herself with the addition of services which have been included in the WhatsApp facility.
Deem shall endeavour to provide the WhatsApp facility on a best effort basis and the Customer shall not hold Deem liable for non-availability of the WhatsApp facility or non-performance by service providers, if any, engaged by Deem or any loss or damage caused to the Customer as a result of use of the WhatsApp facility for causes which are not attributable to Deem. Deem shall not be liable in any manner to the Customer in connection with the use of the WhatsApp facility.
Deem shall endeavour to carry out the instructions received from the Customer through the WhatsApp channel promptly, provided that Deem, shall not be responsible for the delay in carrying out such instructions due to any reason whatsoever, including, but not limited to, failure of operational system or any requirement of law or Deem’s internal policies.
The Customer accepts that each WhatsApp communication may contain certain account information relating to the Customer. The Customer authorizes Deem to send account related information, though not specifically requested, if Deem believes that the same is relevant.
Deem shall not be held responsible for the confidentiality, secrecy and security of the personal or account information being sent through the WhatsApp facility. The Customer agrees that the access to the WhatsApp facility shall be only through the Registered Customer Number and any transaction which originates from the same, whether initiated by the Customer or not, shall be deemed to have originated from the Customer.
Deem shall not be held liable under any circumstance, if the WhatsApp facility is not available for reasons including but not limited to natural calamities, epidemic/pandemic, legal restraints, faults in the telecommunication network or network failure, or any other reason beyond the control of Deem. Deem shall not be liable under any circumstances for any damages whatsoever whether such damages are direct, indirect, incidental consequential and irrespective of whether any claim is based on loss of revenue, interruption of business or any loss of any character or nature whatsoever and whether sustained by the Customer or by any other person. Illegal or improper use of the WhatsApp facility shall render the customer liable for payment of financial charges as decided by Deem or will result in suspension of the WhatsApp facility for the Customer.
Deem shall not be held liable under any circumstance for any error or omission in the services provided by any cellular or any third party service provider (whether appointed by Deem in that behalf or otherwise) to the Customer, which may affect the WhatsApp facility.
Deem, does not warrant the confidentiality or security of the messages whether personal or otherwise transmitted through the WhatsApp facility. Deem makes no warranty or representation of any kind in relation to the system and the network or their function or performance or for any loss or damage whenever and howsoever suffered or incurred by the Customer or by any person resulting from or in connection with the WhatsApp facility.
Without limitation to the other provisions of these WhatsApp Terms and Conditions, Deem, its employees, agent or contractors, shall not be liable for and in respect of any loss or damage whether direct, indirect or consequential, including but not limited to loss of revenue, profit, business, contracts, anticipated savings or goodwill, loss of use or value of any equipment including software, whether foreseeable or not, suffered by the Customer or any person howsoever arising from or relating to any delay, interruption, suspension, resolution or error of Deem in receiving and processing the request and in formulating and returning responses or any failure, delay, interruption, suspension, restriction, or error in transmission of any information or message to and from the telecommunication equipment of the Customer and the network of any cellular service provider and Deem’s system or any breakdown, interruption, suspension or failure of the telecommunication equipment of the Customer, Deem’s system or the network of any cellular service provider and/or any third party who provides such services as is necessary to provide the WhatsApp.
Nevertheless, anything in the contrary provided in this terms and conditions, Deem shall not be involved in or in any way liable to the Customer for any dispute between the Customer and a cellular service provider or any third party service provider or WhatsApp (whether appointed by Deem for such purpose or otherwise) while availing these Services through the WhatsApp platform.
The Customer shall not interfere with or misuse in any manner whatsoever the WhatsApp facility and in the event of any damage due to improper or fraudulent use by the Customer, the Customer shall be liable for damages to Deem or for any losses suffered by Deem.
The Customer agrees that Deem assumes no liability whatsoever in case of any event of such compromise of the Customer’s WhatsApp and Deem shall not be held responsible for any such event. Further, the Customer agrees and understands that WhatsApp can also be logged on from more than one device at the same time, including by using web log in and the Customer is aware of the risk in this regard while availing the Services such as compromise of Customer Information, breach of security of the Customer’s WhatsApp account from a device other than the Customers and the Customer undertakes to be vigilant and careful and takes full responsibility for the security of his/her WhatsApp account. Deem shall not be responsible or liable to you or any third party for the consequences arising out of or in connection with using of this Service.
7. INDEMNITY
In consideration of Deem providing the WhatsApp facility, the Customer, at his/her own expense, agrees to indemnify, defend and hold harmless, Deem, its employees, representatives, agents, customers and/or the affiliates, as the case may be, against all losses, damages, expenses, actions, claims, demands and proceedings whatsoever, that Deem may incur, sustain, suffer or be put to at any time as a consequence of acting on or omitting or refusing to act on any instructions given by the Customer or otherwise for use of the WhatsApp facility.
The Customer further specifically agrees to indemnify, defend and hold harmless, Deem and/or its affiliates from any losses occurring as a result of the:
i. the Customer permitting any third parties to use the WhatsApp facility.
ii. the Customer permitting any other person to have access to his mobile phone or as a consequence of leaving the mobile phone unattended or loss of mobile phone and Deem acting/not acting on any instructions received from the same.
iii. the Customer having breached the WhatsApp Terms and Conditions.
8. TERMINATION
Deem may, at its discretion,
· withdraw temporarily or terminate the WhatsApp facility, either wholly or in part, at any time without giving prior notice to the Customer.
· Deem may, without prior notice, suspend the WhatsApp facility at any time during which any maintenance work or repair is required to be carried out or in case of any emergency or for security reasons, which require the suspension of the WhatsApp facility.
· Deem may suspend or terminate WhatsApp facility without prior notice if the Customer has breached these WhatsApp Terms and Conditions or Deem learns of the death, bankruptcy.
14. INTELLECTUAL PROPERTY
The Customer acknowledges that the software/ other internet related software which are required for providing the Services or any Intellectual Property Rights of the Deem in the process are the legal property of Deem/ respective service providers.
The permission given by Deem to avail of the Services to the Customer will/ does not create or convey any rights, title or interest to the Customer or to any person, in the above software or Intellectual Property Rights of Deem.
The Service is protected by copyright, trademark, and other laws of the UAE.
15. DISCLOSURE
The Customer hereby expressly authorize and give consent to Deem to share, exchange, disclose, transfer or part with any of Account information or personal data, contained provided to/ available with Deem, when Deem considers such disclosure as necessary or expedient, with:
a. WhatsApp, employees or agents of Deem, group entities, subsidiaries, branches in any jurisdiction;
b. Auditors, any agencies/credit bureaus, any court or tribunal or any statutory, regulatory, judicial, UAE Central Bank, governmental or administrative authority having jurisdiction over Deem or its group entities/subsidiaries/branches;
c. Service providers or any such person with whom Deem contracts or proposes to contract in relation to the provision of services in respect of the account or facilities;
For the purpose: -
a. of compliance with applicable laws and regulations or any order (judicial or otherwise), statutory or regulatory requirement to which Deem, its subsidiaries or any it’s offices are subject to; or
b. of facilitating services through the WhatsApp platform or otherwise); or
c. disclosures for credit review of any account, assets or service or any credit facilities received/availed/held by the Customer from Deem (whether singly or jointly or otherwise); or
d. for authentication or verification purposes, or
e. research or analytical purposes, credit reporting, credit scoring, risk management, anti-money laundering and combating financing terrorism checks, participation in any telecommunication; or
f. to design financial services and to offer an enhanced, personalized online experience on the Website and third party websites or otherwise.
g. for enabling registration/verification/offering of any products or any investments to be made by the Customer with Bank’s group companies/other companies.
16. GOVERNING LAW
These WhatsApp terms and conditions shall be governed by laws of the UAE. Any dispute or differences arising out of or in connection with the WhatsApp facility shall be subject to the exclusive jurisdiction of the UAE.
The Services provided to the Customer are subject to applicable law and the rules, regulations, notifications, circulars and guidelines introduced or amended from time to time by Central Bank of the UAE and/or any regulatory/ statutory/ governmental authority.
